(Mexico) SAT publishes new amendments to general foreign trade rules
On 22 June this year, the Tax Administration Service (SAT), Mexico’s highest tax authority in Mexico, issued a ruling , announcing amendments to rules 3.1.35 and 3.1.36 and the repeal of the single transitory article, section III.
These rules refer to intensive widespread use of the CFDI schema and integration of the export complement, designed to replace the Electronic Value Proof (COVE) in the coming months as the electronic standard in transnational operations. The changes are described in greater depth below.
Amendments to article 3.1.35
Use of the export-associated CFDI is protected with the "A1" order key for those cases where the goods are to be sold. Likewise, in situations where the CFD I is transmitted with the data referred to in the Foreign Trade complement issued by the SAT, it will replace transmission of the value proof.
Amendments to article 3.1.36
Customs agents must now bear additional responsibilities with reference to article 54, which concerns the authenticity, veracity and accuracy of the data and information provided, as well as determining the customs regime for the goods and their proper tariff classification.
They must also ensure that the exporters have the documents accrediting compliance with all their obligations in terms of regulation and non-tariff restrictions governing said goods. This way, the obligation to validate the fiscal folio number/s of the CFDIs covered by the operation is maintained.
Facilities to adapt to change
Finally, new dates for entry into force are defined. 1 July 2016 is kept for regulations 3.1.35 and 3.1.36 on use of the CFDI as proof of the value of goods exported.
Moreover, integration of the Foreign Trade complement in the CFDI will be compulsory as of 1 January 2017, thus extending the period for optional use of said complement.
